WordPath - Terms and Privacy

TERMS

By playing WordPath, you accept and agree to these Terms and Privacy (Terms). If you do not consent to these Terms, you should not play WordPath.

1. About WordPath

WordPath is a unique word game in which the player must identify a word from distributed letters on the game board and connect these letters in the correct order via a path that fills the entire game board. It was developed by Mind The App Yazilim Teknolojileri Anonim Sirketi (Mind The App). WordPath is available in the App Store and can be downloaded in certain countries and regions. The main motivation and purpose of WordPath is to offer the players a multifacet word game experience with challenging and intriguing gaming elements.

2. User Obligations

While using WordPath and services provided within, you must follow some simple rules. WordPath is only available for your private use and is not intended for commercial use. Do not misuse WordPath and services provided within, so that either WordPath or anyone else is harmed in any way. You may only use WordPath and services as permitted by these Terms and law. By using WordPath, you agree that:

You are solely responsible for the activities and all the content uploaded or created under your WordPath account.

WordPath does not monitor the user contents, but may at any time choose, at its sole discretion, to remove user content from WordPath and/or your user account and to terminate your account and membership.

Your sign-up to WordPath, including your email and password, is personal and should not be transferred to or used by someone else. You are responsible for securing your login credentials. While taking extensive measures for the security of user data, WordPath is not in any way responsible for any loss or damage caused by unauthorized access to your account or use of your login credentials. If you suspect any unauthorized access to your account, you must immediately contact WordPath. Contact info are available at the bottom of this Terms.

You must not engage in any unlawful activities on WordPath, including but not limited to contributing with information which in any way contains or involves incitement to racial hatred, defamation, harassment, child pornography or pornography.

You may not transmit, and/or distribute files that may damage WordPath or the users.

You may not share others’ personal information, without their approval.

You are not entitled to assign your rights and/or obligations under these Terms or use of WordPath to any third party without WordPath’s prior written consent. WordPath is entitled to assign its rights and/or obligations under these Terms.

Violation of any of these Terms will lead to a direct termination of your user account. If you violate these terms, you will not get a refund for your paid in-app purchases.

3. Intellectual Rights

All rights in and to WordPath, including any trademarks, service marks, trade names and copyrighted content (Intellectual Property) presented within WordPath are the property of WordPath and/or third parties. You agree not to use Intellectual Property for any other purposes except for your use of WordPath unless required otherwise by applicable mandatory law.

By submitting User Material to WordPath, you warrant and represent that you hold the copyright, trademark and/or other intellectual property rights to your content. You agree to grant WordPath a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use User Material to the extent necessary for WordPath to operate and maintain its services. This license shall remain valid until the respective User Material is deleted from WordPath by you or by WordPath in accordance with these Terms.

4. Disclaimer and Limited Liability

You use WordPath at your own risk. WordPath is provided “AS IS,” without any warranties, and WordPath does not warrant that its service and availability thereof will be uninterrupted or error-free. WordPath does not assume any responsibility for errors or omissions in the information or software or other documents, including User Material, which is referenced by or linked to. References or links to third parties’ websites are provided "AS IS", without warranty of any kind, either express or implied.

In no event shall WordPath be liable for any indirect or consequential damages, except in cases of intentional misconduct or gross negligence.

5. Changes in Terms

WordPath may update and/or modify these Terms from time to time and the most current version will always be posted on mindtheapp.io/wordPathTermsPrivacy. Any and all material changes shall become into effect between you and WordPath upon your acceptance of such changes by using the services after such notification has been made to you.

6. Governing Law and Dispute Resolution

These Terms are governed by the laws of Turkey, except for its conflicts of laws principles. All claims arising out of or relating to these Terms shall be resolved by Istanbul Public Courts.

We value your privacy.

By installing WordPath mobile application (WordPath), you accept this Privacy Policy and the processing of your personal data accordingly.

When you install WordPath and sign up as a registered user, WordPath does not collect any personal sensitive data such as your email address, name, age and gender.

As you use WordPath, your gaming data regarding the application usage such as the levels and categories completed, and number of hints used are collected to improve your gaming experience.

We value your privacy and will only process your personal data in accordance with this Privacy Policy and releavant laws and regulations.

4. Processing of Personal Data

In order to offer you the best gaming experience, your gaming data regarding the application usage may be processed. As an example, we process level and category completions to provide a better navigation in the game.

5. User Profiling

WordPath will process certain application usage data within the framework of user profiling. However, the data collected and processed in this regard is anonymous and will not be linked to your personal information.

Third parties will not have access to your data for any other purpose than for WordPath to reach new customers in marketing platforms.

The profiling of your data does not require any consent as a legal ground to be processed. If this should be the case under relevant personal data regulation, you hereby give your consent to WordPath using your personal data as defined above for user profiling for the purpose of improving the gaming experience and performance of the users.

6. Marketing

WordPath may use your personal data for profiling and marketing purposes via emails and push notifications. However, no third parties will be allowed to access your data for marketing purposes. No personal data will be transferred to third parties for marketing purposes.

The use of personal data for marketing purposes will only concern personal offers that have a close relation to your use of the services provided by WordPath. These marketing offers will be sent to you by WordPath. This processing is based on a legitimate interest, on our side the interest to offer you the best possible service, on your side the possibility to be offered relevant products and services relevant to your use of the services. This does not require your consent. If this should be the case under relevant personal data regulation, you hereby give your consent to us using your personal data as defined above.

In case you do not want WordPath to use your personal data for the purpose of marketing as described above, you may at any time unsubscribe from any further marketing messages by clicking the "unsubscribe" link at the bottom of such messages, or by using relevant opt-out features available in the settings of WordPath.

7. Access and Erasure of Personal Data

You have the right to request access to or erasure of your personal data processed by WordPath. Please contact us via support@mindtheapp.io for your requests.

8. Storage of Personal Data

Except where you delete your application data permanently, request erasure of the relevant personal data, or opt out from processing relating to marketing, WordPath stores and processes your personal data for as long as you are a registered user of WordPath. We will stop storing and processing your personal data if you delete your application data, if you request erasure of your personal data, or opt out from marketing, unless it is necessary for us under legal requirements to store or process the relevant personal data for a longer time.

9. Transfer of Personal Data

Personal data collected from you may be shared with third-party providers of WordPath that process personal data on behalf of WordPath; such as database service providers, data storage providers, data analytics providers, customer support and relationship systems. These service providers will be considered processors of your personal data.

Some of your personal data may be transferred to and processed by processors, as described above, that are established in the United States or other countries (some of which will be outside the EEA). We may also transfer your personal data in the event that our business (or part of it) is sold, for instance as part of a merger or acquisition. WordPath will always apply safeguards to protect your personal data from unauthorized disclosure. In case of transfer of data to third parties that are outside of the EU or EEA and that do not offer an adequate level of data protection, WordPath will apply the EU Commission’s model clauses and/or binding corporate rules, or similar instruments/mechanism, for the safeguarding of integrity and security.

WordPath will not transfer your personal data to third parties with the right for such parties to use the data other than on behalf of WordPath as described above.

WordPath may further disclose your personal data in order to comply with a legal or regulatory obligation, if required by law, regulation or other legislation, or in order to protect and defend WordPath's or users’ rights and interests, subject always to relevant applicable personal data regulation.

11. Security of Personal Data

The security of your personal data are of great importance to WordPath. In addition to complying with applicable relevant personal data regulations, we exercise and use state of the art standards and technologies such as firewalls, security software, etc., in order to protect your personal data and to prevent any unauthorized and unauthenticated access. However, no system can be 100% secure, and despite our efforts, there is always a risk of unauthorized access to your personal data. By using WordPath, you assume this risk.

We also urge you to further limit access to your mobile phone after having used WordPath.

12. Children

If you are under age 4, you are not allowed to submit any personal data through WordPath. Further, we encourage parents and legal guardians to monitor their children’s mobile use and to help us in enforcing our Privacy Policy by instructing their children to never provide any personal data through WordPath without their permission. If you become aware that a child under the age of 4 has submitted personal data to us, please contact us at support@mindtheapp.io for quick and proper action.

13. Policy Changes

We reserve the right to update and/or change this Privacy Policy at any time. We urge you to review this Privacy Policy frequently.

14. Contact

We will communicate with you by email and mobile push notifications. If you do not wish to receive push notifications on your mobile device, you can always turn off this from the settings of your mobile phone or opt-out from Reminders within the application. Please be aware that opting out from the reminder notifications may degrade your in-app experience. Further be aware that if you unsubscribe from our mailing list you will still be receiving answers to your questions sent to our support but you will not be receiving promotional emails.
